1. Intellectual Property & Copyright

All photographs, digital images, and content displayed on this website are the exclusive intellectual property of the LLC and its artists. They are protected by United States and international copyright laws. You may not download, reproduce, copy, or distribute any image without explicit written permission.

2. Permitted Use & Licensing

 

  • Standard Physical Prints: Purchase grants you a personal, non-commercial license to display the physical artwork.
  • Standard Digital Downloads: Purchase grants a non-exclusive, non-transferable license for personal, private use only.
  • Prohibitions: You may not resell, sub-license, alter, or use standard products for commercial profit.

3. Commercial Licensing Options

Businesses seeking to use images for marketing, web design, print media, or other corporate uses must purchase a specific Commercial License. Commercial terms, usage rights, and fee structures are handled on a case-by-case basis and require a separate, signed contract with our LLC before any commercial deployment.

4. Orders, Pricing & Payments

By placing an order, you agree to provide current, accurate account and billing information. All prices are listed in USD unless stated otherwise. We reserve the right to refuse or cancel any order at our sole discretion. Payments are processed securely through our designated third-party processors.

5. Shipping, Delivery & International Customs

 

  • Digital Products: Access links are delivered via email immediately after payment verification.
  • Physical Prints: Processing takes 3–5 business days before shipment.
  • International Shipping: We ship worldwide via USPS, FedEx, or DHL. Delivery times vary by carrier and destination country.
  • Duties & Taxes: International customers are solely responsible for all import duties, customs fees, and local taxes levied by the destination country.

6. Returns, Refunds & Cancellations

 

  • Physical Prints: Contact us within 7 days of delivery with photos if items arrive damaged. We will issue a replacement or refund.
  • Digital Downloads: All sales of digital products are final and non-refundable due to their immediate download nature.

7. Limitation of Liability

As a limited liability company, LLC, our liability is strictly limited to the maximum extent permitted by law. In no event shall the LLC, its owners, or employees be liable for indirect, incidental, or consequential damages. Our total liability shall not exceed the exact purchase price paid for the product in question.

8. Governing Law

These Terms of Service and any disputes arising from your use of this website or purchases shall be governed by and construed in accordance with the laws of the State of New Mexico, without regard to conflict of law principles.
